How to Make a Complaint

Any person can make a complaint to the Turks and Caicos Integrity Commission if they have reasonable grounds to believe that a Public Official has performed any of the following acts:

  • Committed an Act of Corruption
  • Breached the Code of Conduct
  • Breached the Turks and Caicos Islands Constitution
  • Breached the Integrity Commission Ordinance
  • Breached the Political Activities Ordinance
  • Has a Conflict of Interest in relation to their duties

A person can make a complaint to the Commission by using any one of the following mediums:

  • Completing the secure online form
  • Downloading and completing the complaint form and returning it to us using any of the below options:

For highly confidential information we recommend that either the secure online form, post, or in-person submission methods be used.

When a person makes a complaint to the Integrity Commission they may choose to either identify themselves or to have the Commission keep their identity anonymous.

Confidential / Anonymous Reports

All public officials who submit reports to the Integrity Commission are protected under the Whistleblowers section of the Integrity Commission Ordinance. For persons who wish to provide information to the Commission in confidence, Commission staff are trained to deal with confidential reports or they can be submitted online without providing personal details. The Integrity Commission has systems and processes in place to prevent unauthorized disclosure and give absolute assurance that personal details will never be given out without consent.

Whistleblower Protection

The ‘Whistleblower Protection’ provisions outlined in the Integrity Commission Ordinance provide for protected disclosures. These provisions were designed to engender a culture of reporting genuine cases of wrongdoing in the public sector and to ensure that persons who make such complaints/reports to the Commission or to other relevant authorities do not suffer any detriment or are otherwise penalized for doing so. A Public Official who makes a complaint/ report about another public official is protected under these provisions. These provisions are outlined in Section 58D of the Integrity Commission Ordinance.

Maliciously made False Complaints/Reports

All complaints received by the Commission are accepted on the basis that they were submitted in good faith. Any person who maliciously makes a false allegation or maliciously provides false information against a public official commits a criminal offense under the Integrity Commission Ordinance. This offense is punishable by either fine or imprisonment or both.

Duty of Public Officials to Report Acts of Corruption

All Public Officials are mandated by the Integrity Commission Ordinance to report to the Commission, any known or suspected instances where another Public Official has been is or is likely to be engaged in a corrupt act. The failure of a Public Official to report his knowledge or suspicion is a criminal offense punishable by either fine or imprisonment or both.
